Sales Policy

DSM Designs LLC does not accept responsibility for installation or assembly of any items purchased that are not installed by the DSM Designs team. DSM Designs LLC is not responsible for maintenance of any of our products. Proper use and maintenance are the sole responsibility of the customer. DSM Designs LLC is not responsible nor has knowledge of individual building codes or laws. Please check with your local government offices regarding any questions that you may have.

Compliance with all local, state, and federal codes is the sole responsibility of the customer. All sales purchased through DSM Designs LLC are final. No exchanges or refunds will be given. Custom orders cannot be returned for any reason whatsoever.

Payment Policies

All purchases must be prepaid. DSM Designs LLC accepts Visa, MasterCard, American Express, and Discover. Custom orders cannot be returned unless there is a manufacturing defect.

Exchanges, Returns, & Refunds

All sales purchased through DSM Designs LLC are final. No exchanges or refunds will be given. Custom orders CANNOT be returned for any reason whatsoever.

Shipping Information

When your order has shipped, you will receive an email with tracking information and freight carriers contact information.  Please allow 3-7 days for the delivery.  Your order will ship LTL (less than truckload) unless otherwise stated.

If your unit is over 7’ the freight company may not be able to guarantee a lift gate.  A lift gate is always requested but you will be responsible for unloading your units from the truck if they are unable to provide a lift gate. You can verify this when they call to set up the delivery appointment.  Most of our cabinetry is heavy and you will need a few strong people to carry the units into your space.   Never lift a unit by the shelves when unloading or moving.

LTL service does not include set up or assembly of items or removal of packaging materials. Your order will be shipped to a local delivery terminal. The delivery terminal will call you when your order arrives at the final terminal to schedule a delivery appointment. Deliveries are made between the hours of 8:00 AM and 5:00 PM Monday through Friday and will be scheduled as a 4-hour window. A signature is required for all deliveries; the driver is unable to complete delivery without a signed delivery receipt.  Please make sure you receive the number of units stated on the delivery form before signing. 

Upon delivery, please inspect the crate for any damage. If you notice any damage to the crate, please write crate damaged/possible concealed damage on the delivery ticket before you sign it! Also take some pictures in case a claim needs to be filed.  If refusing delivery due to damage, please note refused due to damage the delivery ticket before you sign it and take some pictures.

You will need a screw gun/screwdriver to uncrate the unit.  Please make sure you uncrate the unit and inspect within 24 hours of delivery. 

If there is any damage please email a description of damage, pictures and a copy of the delivery ticket to info@dsmdesigns.net to start a claim. Freight claims cannot be processed unless damage is noted on a delivery form.

Marketing

DSM Designs LLC shall not be held responsible for incorrect information including but not limited to typographical, clerical, pictorial, or pricing errors and reserves the right to refuse or cancel any orders extending from such errors. If an error is recognized in any marketing or sales materials, DSM Designs LLC agrees to promptly inform the customer of such and provide updates to said materials in a timely manner. Customers are encouraged to call DSM Designs LLC directly at (515)-965-3182 if they feel something may be listed in error.

Special Sales & Pricing

Special Sales & Discounts will be for limited times only. Advertised percentage discount prices may apply to specific marked/listed items only. Discounts will be applied to merchandise before shipping and/or tax. No limit of the same product per customer, while supplies last. Offer valid online on the DSM Designs LLC website for specific times as promoted. Not valid on previous or future purchases, cannot be combined with volume discounts, or other product promotions or offers.
During sales/promotions, items may sell out and will be put on a backorder status with first come, first serve method being practiced. Not redeemable for cash. DSM Designs LLC reserves the right to cancel special sales, discounts, and promotions at any time.

TERMS AND CONDITIONS OF SALE

These terms and conditions of sale, which appear on all invoices, are the terms and conditions upon which DSM Designs LLC makes all sales. DSM Designs LLC will not accept any other terms and conditions of sale, unless Buyer and DSM
Designs LLC have executed a written agreement which specifically modifies, supersedes and/or replaces these terms and conditions. Acceptance of all purchase orders is expressly made conditional upon Buyer’s assent, expressed or implied, to the terms and conditions set forth herein without modification or addition.

ACCEPTANCE OF INVOICES & MERCHANDISE

Buyer’s acceptance of these terms and conditions shall be indicated by any of the following, whichever first occurs: (a) Buyer’s making of an offer to purchase product from DSM Designs LLC; (b) Buyer’s written acknowledgment hereof; (c)
Buyer’s acceptance of any shipment of any part of the items specified for delivery (the “Products”); or (d) any other act or expression of acceptance by Buyer. DSM Designs LLC acceptance is expressly limited to these terms and conditions in their entirety without addition, modification or exception, and any term, condition or proposals hereafter submitted by Buyer (whether oral or in writing), which is inconsistent with or in addition to these terms and conditions, is objected to and is hereby rejected by DSM Designs LLC. DSM Design LLC’s silence or failure to respond to any such subsequent or different term, condition, or proposal shall not be deemed to be DSM Design LLC’s acceptance or approval thereof.

DELIVERY

Unless otherwise agreed in writing, delivery shall be made in accordance with DSM Designs LLC shipping policy in effect on the date of shipment. For all domestic transactions, unless otherwise stated on the front of the invoice, title to the Products and all risk of loss or damage with respect to the Products shall pass to Buyer upon delivery by DSM Designs LLC to the carrier or Buyer’s representative at DSM Designs. Buyer shall promptly notify DSM Designs LLC, in no event later than 24 hours after delivery, of any claimed shortages or rejection as to any delivery. Such notice shall be in writing and shall be reasonably detailed, stating the grounds for any such rejection. Failure to give any such notice within such time shall be deemed an acceptance in full of any such delivery. DSM Designs LLC shall not be liable for any shipment delays beyond the reasonable control of DSM Designs LLC which affect DSM Designs LLC or any of DSM Designs LLC suppliers, including, but not limited to, delays caused by unavailability or shortages of Products from DSM Designs suppliers; natural disasters, acts of war; acts or omissions of Buyer; fire, strike, riot, or governmental interference; unavailability or shortage of materials, labor, fuel or power through normal commercial channels at customary and reasonable rates; failure or destruction of plant or equipment arising from any cause whatsoever; or transport failures. DSM Designs LLC will NOT accept reconsignments for any freight delivery whatsoever.

LIMITATION OF LIABILITY

DSM Designs LLC shall not be liable under any circumstances for any special, consequential, incidental, PUNITIVE or exemplary damages arising out of or in any way connected with the agreement to sell Product to Buyer or the Product, including, but not limited to, damages for lost profits, loss of use, lost data or for any damages or sums paid by Buyer to third parties, even if DSM Designs LLC has been advised of THE possibility of such damages. The foregoing limitation of liability shall apply whether any claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise.

GENERAL

These terms and conditions shall constitute the final, complete and exclusive agreement of the parties with respect to all sales by DSM Designs LLC to Buyer and shall supersede all prior offers, negotiations, understandings and agreements. Unless Buyer and DSM Designs LLC have executed a written agreement which specifically modifies, supersedes and/or replaces these terms and conditions, it is expressly agreed that no prior or contemporaneous agreement or understanding, whether written or oral, shall contradict, modify, supplement or explain these terms and conditions. No additional or different terms or conditions, whether material or immaterial, shall become a part of any sales agreement unless expressly accepted in writing by an authorized officer of DSM Designs LLC in the United States. Any waiver by DSM Designs LLC of one or more of these terms and conditions or any defaults hereunder shall not constitute a waiver of the remaining terms and conditions or of any future defaults. No failure or delay by either party in exercising or enforcing any right hereunder shall operate as a waiver thereof or preclude any other exercise or enforcement of its rights. Any provision of these terms and conditions that is prohibited or unenforceable under the laws of the State of Iowa shall be ineffective to the extent of such prohibition or unenforceability, without impairing or invalidating the remaining provisions of these terms and conditions. All sales agreements shall be deemed made in, and shall be governed by, the laws of the State of Iowa. The venue for any disputes arising out of any sales agreement shall be, at DSM Designs LLC sole and exclusive option, or the courts with proper jurisdiction at Buyer’s location.

ALL SALES TRANSACTIONS EXCLUDE THE APPLICATION OF THE 1980 UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS, IF OTHERWISE APPLICABLE.

 

WARRANTY

Thank you for choosing DSM Designs LLC for your cabinetry needs. We are proud to offer a one-year warranty on all our manufactured cabinetry, which includes laminates, drawer slides, and hinges.

Our warranty provides coverage against factory defects in materials or workmanship. In the unlikely event that your product fails under normal use due to such defects, we will either repair or replace it with a comparable product or part. Please note that labor costs are not included in our warranty coverage.

It is important to note that our warranty does not cover damage resulting from normal wear and tear, abuse, misuse, alteration, improper installation or maintenance, damage caused by water or fire, discoloration, fading or staining of fabrics, chipping, fading or peeling of laminates or finishes, or any acts of nature, such as fire, water damage, freeze, or laminate shrinkage due to improper climate regulations.

Our warranty is non-transferable and applies only to the original purchaser of the product. To be eligible for warranty service, all defective products, parts, and components may be requested to be returned to DSM Designs LLC to receive warranty credit. Failure to return these items may result in the need to pay for warranty invoices.

Please be aware that the replacement of any parts within the warranty period does not extend or restart the warranty period.

For warranty claims, please email info@dsmdesigns.net and provide the following information:

  1. Photographic/video documentation clearly showing the damage or failure at the time of the warranty claim. It is the customer’s responsibility to provide clear evidence of the damage/defect through digital photographs or videos.
  2. Original invoice number, purchase name, and shipping address.
  3. Contact name, phone number, and email address.

Within the first 30 days of delivery, DSM Designs LLC will cover the shipping costs associated with warranty issues in both directions. After this initial period, the buyer may be responsible for shipping the defective products back to DSM Designs LLC.

Please note that the merchandise purchased from DSM Designs LLC is intended for professional use only and should be assembled and installed by a licensed professional.

In no event shall DSM Designs LLC be liable for an amount exceeding your purchase price.
